Swans Trail Farms – Full Liability Waiver

By purchasing a ticket and/or entering Swans Trail Farms, I acknowledge and agree to the following:

1. Assumption of Risk

I understand that visiting a working farm and participating in agritourism and recreational activities—including but not limited to animal interactions, berry picking, walking fields and pathways, and use of farm attractions—includes inherent and obvious risks.

These risks include, but are not limited to:

• Slips, trips, and falls on uneven ground, dirt paths, mud, holes, ruts, rocks, and natural terrain

• Animal behavior, including bites, kicks, scratches, or sudden movement

• Contact with farm equipment, structures, fences, and tools

• Crowds and the actions of other guests, including children

• Weather conditions, including rain, heat, and slippery surfaces

• Allergic reactions (animals, hay, insects, food, plants)

I voluntarily assume all risks associated with my participation, whether known or unknown.

2. Washington Agritourism Warning

WARNING:
Under Washington state law, there is limited liability for an injury to or death of a participant in an agritourism activity conducted at this agritourism location if such an injury or death results exclusively from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury or death.

We are required to ensure that minors only access age-appropriate activities, equipment, and animals. You are assuming the risk of participating in this agritourism activity.

3. Release of Liability

To the fullest extent permitted by law, I release and hold harmless Swans Trail Farms, its owners, members, employees, and agents from any and all claims, demands, or causes of action arising out of or related to my presence at or participation in activities at the farm, including but not limited to claims for personal injury, illness, death, or property damage, except where caused by gross negligence or willful misconduct.

4. Indemnification

I agree to indemnify and hold harmless Swans Trail Farms, its owners, members, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from my actions or the actions of anyone in my party, including minors under my supervision.

5. Responsibility & Conduct

I agree to follow all posted rules and staff instructions, including all animal interaction guidelines.
I understand that unsafe behavior or failure to follow rules may result in removal from the property without refund.

6. Minor Supervision & Parent/Guardian Agreement (if applicable)

If attending with a minor, I accept full responsibility for their supervision and safety at all times. Children must be closely supervised, especially in animal interaction areas and on uneven terrain.

If I am attending with a minor, I assume all risks for the minor and agree to release and indemnify Swans Trail Farms from any claims arising from the minor’s participation.

7. Medical Authorization (Minors)

In the event of injury or illness, I authorize Swans Trail Farms to obtain emergency medical care for any minor in my care if I cannot be immediately reached.

8. Ticket / Attendance Agreement

I understand that purchasing a ticket and/or entering Swans Trail Farms property constitutes agreement to this waiver.

9. Severability

If any portion of this agreement is found to be invalid, the remaining portions will remain in full force and effect.

Yes, we do! It is located near the Admissions Booth.

Yes! When you arrive, our parking attendants can direct you to handicapped parking spaces. Note that the terrain is grass and we do not have paved handicapped parking.

Includes admission to Barnyard Petting Farm and all the favorite activities on the date and time selected

No early entry to activity area - When purchasing tickets, make sure all people in your party have the same time ticket so everyone can enter together.

We have a limited selection of food items available during the week. You can always stop by the Country Store for snacks and jarred goods!

Wash just before use. Apples ripen 10x faster at room temperature than when kept in a refrigerator. Chilled apples should last 90 days.

• For emergencies, don’t hesitate to call 911 and direct them to 7301 Rivershore Rd. Snohomish, WA 98290.
• Any staff member wearing a red safety backpack is ready to help with minor injuries such as cuts or bee stings. 
• If you need further assistance, find the nearest employee and have them radio for a manager. All managers are trained in First Aid/CPR/AED use.
• We do have an AED on site. It is centrally located in the Apple Shack. 

We use regular procedures to maintain a healthy environment and to protect our guests and employees from the spread of illness. These involve daily cleaning and washdown of outdoor locations, handwashing stations throughout the premises, strict sanitation standards for our food preparation areas, and rapid response to spills, garbage, and other hazards.
